It shall be a defence to an action for voidness, voidability or unenforceability of legal acts detrimental to all the creditors, for the person concerned who has benefited from the act concerned, if -
(a) that act is subject to the law of a Member State other than the home Member State, and
(b) that law does not allow any means of challenging that act in the relevant case.
