(1) A responsible person shall ensure that where a UCITS charges an annual management fee calculated on the initial offer price per share of the UCITS -
(a) the UCITS is a structured UCITS which provides a pre-defined return to investors, and
(b) the fee charged is a percentage of the initial offer price per share of the UCITS.
