Recitals
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty establishing the European Community, and in particular Articles 83 and 308 thereof,
Having regard to the proposal from the Commission [OJ C 20, 28.1.2003, p. 4.],
Having regard to the opinion of the European Parliament [Opinion delivered on 9.10.2003 (not yet published in the Official Journal).],
Having regard to the opinion of the European Economic and Social Committee [Opinion delivered on 24.10.2003 (not yet published in the Official Journal).],
Whereas:
(1) Council Regulation (EEC) No 4064/89 of 21 December 1989 on the control of concentrations between undertakings [OJ L 395, 30.12.1989, p. 1. Corrected version in OJ L 257, 21.9.1990, p. 13. Since further amendments are to be made, it should be recast in the interest of clarity.
(2) For the achievement of the aims of the Treaty, Article 3(1)(g) gives the Community the objective of instituting a system ensuring that competition in the internal market is not distorted. Article 4(1) of the Treaty provides that the activities of the Member States and the Community are to be conducted in accordance with the principle of an open market economy with free competition. These principles are essential for the further development of the internal market.
