In Case 2, Case 3 or Case 4, where a compensation scheme order or resolution fund order is required to be made in relation to -

(a) the property transfer instrument, or

(b) the third country instrument making provision which could be made in a property transfer instrument,

that order must include a third party compensation order [Defined in section 49(4) of the Act.].
