(1) If the claimant fails to state in writing, in response to the notice under section 30, within the period specified in it, whether or not he or she accepts the assessment he or she shall be deemed not to have accepted it.

(2) If a respondent fails to state in writing, in response to the notice under section 30, within the period specified in it, whether or not he or she accepts the assessment, he or she shall be deemed to have accepted it.
