77. With regards to CCPs, in EMIR CCPs are not considered as Financial Counterparties under Article 2(8) of EMIR, therefore if an NFC- would enter directly in a derivative contract with a CCP, the CCP would not become responsible and legally liable for the reporting of the details of the derivative on behalf of the NFC-. In such cases, the obligation to comply with the reporting obligation remains with the NFC-.
