Article 6 Public statements in respect of pre-commencement contraventions of the Financial Services Act

(1) Paragraph (3) applies if -

(a) the FCA or the PRA considers that an authorised person before commencement contravened a pre-commencement provision that related to him; and

(b) the Financial Services Authority has not given a written notice under section 60(2) of the Financial Services Act in respect of that contravention.

(2) Paragraph (3) also applies if -

(a) the FCA or the PRA considers that an authorised person before commencement contravened a pre-commencement friendly societies provision that related to him;

(b) that person was, immediately before commencement, a regulated friendly society other than a member society; and

(c) the Financial Services Authority has not given a written notice under paragraph 21 of Schedule 11 to the Financial Services Act [Functions transferred by S.I. 1987/925.] in respect of that contravention.
