Section 398 of FSMA (misleading FCA or PRA: residual cases) applies to a requirement imposed by or under

(a) the capital requirements regulation;

(b) any of the Specified EU Regulations under the Capital Requirements Regulation, as amended from time to time;

(ba) a technical standards made by the PRA or FCA under the functions conferred on them by the Capital Requirements Regulation as amended by Part 4, Chapter 3 of the Capital Requirements (Amendment)(EU Exit) Regulations 2018; or

(c) these Regulations;

as it applies to a requirement imposed by or under FSMA.
