(1) The Regulated Activities Order is amended as follows.

(2) In article 3(1) (interpretation) [Article 3 was amended by S.I. 2006/3384 and 2013/3115; there are other amendments to article 3 but none is relevant to this Order.], in the definition of "home Member State", after "capital requirements regulation" insert ", and, in relation to a mortgage intermediary, has the meaning given by Article 4(19) of the mortgages directive".

(3) In article 4 (specified activities: general) [Article 4 was amended by S.I. 2003/1476, 2006/3384, 2009/1389, 2013/1773 and 1881 and 2014/1292.] after paragraph (4A) insert -

"(4B) Where -

(a) a person is a mortgage creditor or a mortgage intermediary; and
