Directive 2003/41/EC is hereby amended as follows:
(1) Article 9 is amended as follows:
(a) in paragraph 1, point (a) is replaced by the following:
'(a) the institution is registered in a national register by the competent authority or authorised; in the case of cross-border activities referred to in Article 20, the register shall also indicate the Member States in which the institution is operating; that information shall be communicated to the European Supervisory Authority (European Insurance and Occupational Pensions Authority (hereinafter 'EIOPA'), established by Regulation (EU) No 1094/2010 of the European Parliament and of the Council [O5J L 331, 1.12.2010, p. 48.] which shall publish it on its website';
(b) paragraph 5 is replaced by the following:
'5. In the case of cross-border activity as referred to in Article 20, the conditions of operation of the institution shall be subject to a prior authorisation by the competent authorities of the home Member State. When giving s
