39 An offence of conspiracy falling within section 5(2) or (3) of the Criminal Law Act 1977 (forms of conspiracy not affected by abolition of offence of conspiracy at common law).
(1) An attempt under a special statutory provision.
(2) Sub-paragraph (1) is to be read with section 3 of the Criminal Attempts Act 1981.
