(1) Nothing in paragraph 17(9)(b) of Schedule 6A to the Bank of England Act 1998 prohibits the making of a rule by the PRA that references a countercyclical capital buffer rate set by the FPC under this Part [1998 c.11, paragraph 17(9)(b) inserted by paragraph 1 of Schedule 1 of the Bank of England and Financial Services Act 2016 c.14; 2000 c.8, Schedule 1ZA substituted by Schedule 3 of the Financial Services Act 2012 c.21.].
