Recitals

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 113 thereof,

Having regard to the proposal from the European Commission,

After transmission of the draft legislative act to the national parliaments,

Having regard to the opinion of the European Parliament [Opinion of 27 March 2019 (not yet published in the Official Journal).],

Having regard to the opinion of the European Economic and Social Committee [Opinion of 17 October 2018 (OJ C 62, 15.2.2019, p. 108).],

Acting in accordance with a special legislative procedure,

Whereas:

(1) Council Directive 2008/118/EC [Council Directive 2008/118/EC of 16 December 2008 concerning the general arrangements for excise duty and repealing Directive 92/12/EEC (OJ L 9, 14.1.2009, p. 12).] has been substantially amended several times. Since further amendments are to be made, that Directive should be recast in the interests of clarity.

(2) Conditions for charging excise duty on goods covered by Directive 2008/118/EC need to remain harmonised in order to ensure the proper functioning of the internal market.
