Regulation 22 Appointment of the auction platform

(1) The auctioneer may appoint a recognised auction platform to auction allowances as provided for in these Regulations.

(2) Subject to paragraph (4), the selection of an auction platform or appointment under paragraph (1) must be made on the basis of a selection procedure which -

(a) complies with best procurement practice, and any applicable law on procurement; and

(b) includes a full public procurement process.

(3) The term of an auction platform appointed under paragraph (1) may be no longer than 3 years, renewable for no more than a further 2 years.

(4) Paragraph (2) does not apply if the recognised auction platform appointed under regulation 4 of the Community Emissions Trading Scheme (Allocation of Allowances for Payment) Regulations 2012 [S.I. 2012/2661.] is appointed as the auction platform under this regulation.

(5) For the purposes of these Regulations, "recognised auction platform" means a recognised investment exchange, in relation to which a recognition order under the Recognised Auction Platforms Regulations 2011 [S.I. 2011/2699.] is in force.
