(1) Where the Regulator considers that there is or has been serious or repeated non-compliance by an undertaking with the conditions attached to its general authorisation or a licence, or a right of use for numbers granted to it or a specific obligation and that undertaking has, in the opinion of the Regulator, failed to comply with such conditions or obligations the Regulator may decide, having considered any representations, that the undertaking is no longer authorised under Regulation 4 and may suspend or withdraw any licence, or right of use for numbers granted to the undertaking.
(2) The Regulator shall notify an undertaking where the Regulator proposes to take action under paragraph (1) against it and shall allow the undertaking 28 days to make representations to the Regulator before taking the action.
