(1) Where an order is made under section 12 (2) of the Act of 1995 or section 17 (2) of the Act of 1996 in relation to a member spouse's retirement benefit the designated benefit payable pursuant to that order shall be calculated in accordance with the rules in force of the pension scheme concerned subject to and in accordance with this part of the regulations.
