Regulation 39 Termination of reckonable service of member spouse

Where an order is made in relation to the member spouse's retirement benefit and the member spouse is an active member of the pension scheme concerned at the date of the order, but his reckonable service terminates prior to commencement of his retirement benefit, the designated benefit shall be paid in accordance with this Part of the regulations, and in particular but without prejudice to the generality of the foregoing where part, or all, of the member spouse's retirement benefit on termination of reckonable service is in the form of a refund of his contributions, the part of the designated benefit which relates to the refund of contributions shall be paid to the person specified in the order at the same time as the refund of contributions is paid to the member spouse.
