The Secretary of State is a Minister designated [S.I. 2008/3117.] for the purposes of section 2(2) of the European Communities Act 1972 [1972 c.68. Section 2(2) was amended by section 27(1) (a) of the Legislative and Regulatory Reform Act 2006 (c.51).] in relation to measures relating to consumer credit.

The Secretary of State makes regulations 4(2), 4(4), 5(2), 7, 10(4)(a) and (b), 10(5), 10(7), 10(9) and 12(2)(c) in exercise of the powers conferred by section 2(2) of the European Communities Act 1972 and all other provisions in these Regulations in exercise of the powers conferred by sections 55(1), 182(2) and 189(1) of the Consumer Credit Act 1974 [1974 c.39.
