240. Offences.

Repealed from 1 June 2015

(1) A person guilty under any provision of the Companies Acts of an offence for which no punishment is specifically provided shall be liable -

(a) on summary conviction, to a fine not exceeding £1,500 or, at the discretion of the court, to imprisonment for a term not exceeding 12 months or to both, or

(b) on conviction on indictment, to a fine not exceeding £10,000 or, at the discretion of the court, to imprisonment for a term not exceeding 5 years or to both.

(2) A person guilty under any provision of the Companies Acts of an offence made punishable by a fine of an unspecified amount shall be liable -

(a) on summary conviction to a fine not exceeding £1,500, or

(b) on conviction on indictment, to a fine not exceeding £10,000.

(3) Every offence under the Companies Acts made punishable by a fine not exceeding £1,500 or by imprisonment for a term not exceeding 12 months, or by both, may be prosecuted summarily.
