71. Objections to registration

(1) Any of the persons referred to in section 68(3), or any other person who appears to the Director to have sufficient interest or expertise in the welfare of the donor, may, no later than 5 weeks from the date on which notice is given in accordance with that provision, notify the Director that he or she objects to the proposed registration.

(2) An objection under subsection (1) shall be in such form as shall be specified by the Director under section 79A and shall be accompanied by such fee as shall be prescribed by regulations made under section 79 and may be made on one or more of the following grounds:

(a) that the enduring power of attorney or instrument creating it is not in accordance with section 59, 60 or 63;

(b) that the notice requirement of section 68(3) was not complied with;

(c) that the donor lacks capacity;
