41. Decisions deemed to have been made in certain cases.

(1) Where notice of a decision under section 8 or 17 is not given to the requester concerned or to the person who made the application concerned under section 17 before the expiration of the period specified for that purpose in section 8 or 17, as the case may be, a decision refusing to grant the request under section 7 or the application under section 17 shall be deemed for the purposes of this Act to have been made upon such expiration and to have been made by a person to whom the relevant functions stood delegated under section 4.

(2) Where notice of a decision under section 14 is not given to the person who made the application concerned under that section before the expiration of the period specified in subsection (4) thereof, a decision affirming the decision to which the application relates shall be deemed for the purposes of this Act to have been made upon such expiration.
