The Commission shall designate a member of its staff as a deputy member of the Commission ("deputy commissioner") who shall assume and carry out with the authority of the Commission all of the functions of the Commission, except in accordance with section 40(8B), in the absence of the commissioners or when the membership of the Commission is vacant.
