Article 37 Exclusions from jurisdiction of Pensions Ombudsman

In paragraph (1) of regulation 4 of the Personal and Occupational Pension Schemes (Pensions Ombudsman) Regulations 1996 (exclusions from jurisdiction) [Paragraph (1) was substituted by S.I. 2001/3649, article 539.], after "which can be" insert "(and is in fact)".
