Regulation 5 How a financial conglomerate is to be identified
(1) If the Bank has authorised a regulated entity, it shall, in accordance with Regulations 3, 4 and 6, identify any group to which these Regulations apply.
(2) In carrying out the obligation imposed by paragraph (1) -
(a) the Bank shall co-operate closely with the other competent authorities that have authorised regulated entities in the group, and
(b) if the Bank is of the opinion that a regulated entity authorised by it is a member of a group that may be a financial conglomerate that has not already been identified according to these Regulations, it shall communicate its view to the other competent authorities concerned and to the Joint Committee.
(3) If the Bank is the co-ordinator of a financial conglomerate, it shall notify in writing -
(a) the parent undertaking that heads the group, or
