(1) Proceedings under section 33 or 34 of this Act or the First Schedule to this Act in respect of an offence on a ship may be taken in any place in the State and the offence may for all incidental purposes be treated as having been committed in that place.
(2) No such proceedings shall be instituted except by or with the consent of the Director of Public Prosecutions.
(3) Without prejudice to subsection (2) of this section, no proceedings for an offence under section 34 of this Act alleged to have been committed outside the outer limit of the territorial sea of the State within the meaning of the Maritime Jurisdiction Act 2021 on a ship registered in a Convention state shall be instituted except in pursuance of the exercise, with the authority of the Minister for Foreign Affairs, of the powers conferred by the First Schedule to this Act.
