(1) Where ESMA has delegated any task to the Bank, the obligation of professional secrecy referred to in Article 47(2) of the Directive shall apply to each person who is, or has been, employed by the Bank. Information to which that obligation of professional secrecy applies shall not be disclosed to another person or authority except where such disclosure is necessary for legal proceedings
(2) All the information exchanged under these Regulations between the Bank and ESMA, EBA, the European Supervisory Authority (European Insurance and Occupational Pensions Authority) established by Regulation (EU) No. 1094/2010 of the European Parliament and of the Council [OJ L 331, 15.12.2010, p. 48.] and the ESRB shall be deemed to be confidential, except where the Bank, ESMA or the other authority or body concerned states, at the time of communication, that such information may be disclosed or where such disclosure is necessary for legal proceedings.
