Regulation 25 Co-location and sharing of network elements and associated facilities for providers of electronic communications networks

(1) Following a request to do so by an operator, the Regulator shall, subject to paragraph (7), make a decision whether or not to impose obligations on an operator who holds rights to install facilities, in relation to co-location or sharing of the network elements or associated facilities installed on that basis, where it is necessary to do so in order to -

(a) protect the environment,

(b) protect public health,

(c) protect public security, or

(d) meet objectives of the statutory planning system in the State.

(2) Obligations imposed under paragraph (1) shall be limited to the specific areas where co-location or sharing is necessary for the purpose of the objectives referred to in that paragraph and may include obligations to share network elements or associated facilities installed and sharing of property, including land, buildings, entries to buildings, building wiring, masts, antennae, towers and other supporting constructions, ducts, conduits, manholes, cabinets or measures facilitating the coordination of public works.
