Regulation 121 Resignation, vacancy in office, remuneration, etc., of special manager.

(1) A special manager may resign by giving 2 months' written notice addressed to the resolution authority.

(2) The resolution authority may remove a special manager by way of written notice at any time for any reason.

(3) Where a special manager resigns, is removed or is otherwise unable to act, the resolution authority may apply to the Court to vary the resolution order appointing the special manager under Regulation 108 to appoint another special manager.

(4) The resignation, removal or inability to act of a special manager under this Regulation does not of itself terminate the special management of the institution concerned.

(5) A special manager is entitled to be paid his or her reasonable costs, expenses and remuneration, and to retain the amount of those costs, expenses and remuneration, out of the revenue of the business of the institution under resolution or the proceeds of the realisation of the assets or other funds available to the institution under resolution, subject to th
