Regulations 71, 82, 84, 85, 89 and 90.
(1) Subject to Regulation 83, the employees of the resulting company or companies and their representative body (or both) have the right to elect, appoint, recommend or oppose the appointment of a number of members of the administrative or supervisory body of that company equal to the highest proportion in force in the participating companies concerned before registration of the resulting company or companies.
(2) If none of the participating companies was governed by employee participation rules before registration of the resulting company, the company is not required to establish provisions for employee participation.
(3) In the case of cross-border mergers only, the representative body shall decide on the allocation of seats within the administrative or supervisory body among the members representing the employees from the various EEA states or on the way in which the employees of the successor company may recommend or oppose the appointmen
