Regulation 40 Dispute resolution mechanisms

(1) The Financial Services and Pensions Ombudsman has the authority to adjudicate on any dispute between a consumer and a creditor or mortgage credit intermediary that is alleged by the consumer to arise by virtue of the operation of any of the provisions of these Regulations.

(2) As necessary, the Financial Services and Pensions Ombudsman shall cooperate with the designated body or bodies in another EEA Member State which has responsibility for out-of-court settlement of consumer disputes within the scope of the Directive.
