Regulation 86 Charges applicable

(1) A payment service provider shall not charge a payment service user for the costs the provider incurs in complying with its information obligations or corrective and preventive measures under this Part, save in accordance with Regulation 103(3), Regulation 104(6) or Regulation 111(5).

(2) Where charges are imposed in accordance with the provisions referred to in paragraph (1), they shall be agreed between the payment service user and the payment service provider and shall be appropriate and in line with the payment service provider’s actual costs.

(3) Where -

(a) a payment transaction is provided within the Union, and

(b) both the payer’s and the payee’s payment service providers are, or the sole payment service provider in the payment transaction is, located in the Union,

the payee shall pay the charges levied by his or her payment service provider and the payer shall pay the charges levied by his or her payment service provider.

(4) A payment service provider shall not prevent a payee from -

(a) requesting from a payer a charge,
