For the purposes of the application of Article 21 in the State, the reference to "direct marketing" includes a reference to direct mailing other than direct mailing carried out -
(a) in the course of electoral activities in the State by -
(i) a political party or its members, or
(ii) a candidate for election to, or a holder of, elective political office in the State,
and
(b) by An Coimisiún Toghcháin in the performance of its functions.
