Section 86 of the Personal Injuries Assessment Board Act 2003 is amended -
(a) in subsection (1), by the substitution of "but only if the processing (within the meaning of the Data Protection Regulation) of any particulars constituting personal data (within the meaning of that Regulation) in the database is in accordance with the Data Protection Regulation and the Data Protection Act 2018." for "but only if the database is, for the time being, maintained in accordance with the Data Protection Act 1988", and
(b) by the insertion of the following subsection after subsection (4):
"(5) In this section, 'Data Protection Regulation' means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 [OJ No. L 119, 4.5.2016, p.1] on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).".
