128. Appointment of Pensions Ombudsman.

(1) The Pensions Ombudsman shall be appointed by the Minister and, subject to the provisions of this Act, he shall hold office on such terms and conditions as the Minister may, with the consent of the Minister for Public Expenditure and Reform, determine.

(1A) Without prejudice to subsection (1), the Minister may, subject to the consent of the Minister for Finance, appoint a person who also holds the office of Financial Services Ombudsman to hold the office of the Pensions Ombudsman.

(1B) An appointment referred to in subsection (1A) shall be made for a period that does not exceed the remaining period of appointment of the person concerned as Financial Services Ombudsman.

(2) A person appointed to be the Pensions Ombudsman whose term of office expires by effluxion of time shall be eligible for reappointment as the Pensions Ombudsman.
