39. Payment of allowances and expenses to persons who appear before Head of Financial Regulation.

(1) A person (other than a person to whom subsection (2) applies) who appears before the Head of Financial Regulation in compliance with an evidentiary notice is entitled to be paid such allowances and travelling or other expenses as the Head of Financial Regulation may reasonably allow.

(2) This subsection applies to -

(a) a person whose fitness and probity is being investigated under this Part,

(b) a regulated financial service provider or holding company or a former regulated financial service provider or former holding company, and

(c) a person called or put forward by a person referred to in paragraph (a) or (b) to give evidence.

(3) All allowances and expenses payable under subsection (1) are payable by the Bank.
