Regulation 38 Notification procedure

(1) Where a credit institution established in the State which is authorised by the Bank, or a financial institution in the State carrying on business in accordance with Regulation 32(3), proposes to carry on business in another Member State in any of the categories of activities set out in the Schedule, other than by means of establishing a branch in that Member State, it shall notify the Bank of the name of that Member State and of the activities in the Schedule which it proposes to carry on in that Member State.

(2) The Bank shall, not later than one month after the date of receipt of the notification referred to in paragraph (1), send that notification to the competent authorities of the host Member State in which it proposes to carry on the business.

(3) The notification referred to in paragraph (1) shall not be required if, on 1 January 1993, the credit institution or financial institution concerned already carried on any business in the Member State concerned by means of the prov
