Any measure taken pursuant to Regulation 40(1) or (3) or 42 involving penalties or restrictions on the exercise of -
(a) the freedom to provide services, or
(b) the freedom of establishment,
shall be properly reasoned and communicated, in writing, by the Bank to the credit institution concerned.
