Regulation 117 Requirement to maintain a capital conservation buffer

(1) Subject to Regulation 119, institutions shall maintain, in addition to the Common Equity Tier 1 capital maintained to meet any of the own funds requirements specified in points (a), (b) and (c) of Article 92(1) of the Capital Requirements Regulation, a capital conservation buffer of Common Equity Tier 1 capital equal to 2.5 per cent of their total risk exposure amount calculated in accordance with Article 92(3) of that Regulation on an individual and consolidated basis, as applicable in accordance with Part One, Title II of that Regulation.

(3) Where an institution fails to meet the requirement under paragraph (1), it shall be subject to the restrictions on distributions set out in Regulation 129(3) and (4).
