Nothing in this Act shall authorise any person to use upon a highway a mechanically propelled vehicle so constructed or used as to cause a public or private nuisance, and any person who so uses such vehicle shall, notwithstanding anything in this Act, be liable to an indictment or action, as the case may be, for such use when, but for the passing of this Act, such indictment or action could be maintained.
