126. Penalty for failure to pay hire or fare.

(1) If any person shall refuse or omit to pay to the owner or to the driver or conductor of a licensed public service vehicle any sum which is justly due and payable by such person to such owner or to such driver or conductor on behalf of such owner for the hire of such vehicle such person shall be guilty of an offence under this section and shall on summary conviction thereof be liable to the punishment hereinafter mentioned.

(2) If any person shall refuse or omit to pay to the driver or to the conductor (if any) of a large public service vehicle any sum which is justly due and payable by such person to such driver or such conductor (as the case may be) as the fare for the carriage of such person in such vehicle such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to the punishment hereinafter mentioned.
