52. Prohibition of driving dangerously defective vehicle.

Every person who drives a mechanically propelled vehicle in a public place while such vehicle or the machinery thereof has a defect which such person knew of or could have discovered by the exercise of ordinary care and which is of such character that such vehicle is, when in motion, a danger to other persons and vehicles using such place shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds.
