Article 279 Obtaining a money transfer by deception: interpretation

(1) Section 15B [Section 15B was inserted by the Theft (Amendment) (Northern Ireland) Order 1997 NI 3, Article 3(1).] of the Theft Act (Northern Ireland) 1969 (obtaining a money transfer by deception: interpretation) is amended as follows.

(2) In subsection (4), the words after paragraph (b) are repealed.

(3) After that subsection insert -

"(4A) References in subsection (4) to a deposit must be read with -

(a) section 22 of the Financial Services and Markets Act 2000;

(b) any relevant order under that section; and

(c) Schedule 2 to that Act,

but any restriction on the meaning of deposit which arises from the identity of the person making it is to be disregarded.".
